HOW TO ENTER

2. To enter Wahanda’s 12 Days of Holiday Giveaways Sweepstakes (the “Sweepstakes”), you ("You" or the "Entrant") must go to http://us.wahanda.com (the “Web Site”). You will click on the Sweepstakes link and be brought to a web page that contains the registration form where You will be prompted to enter a valid Email Address and Zip Code in order for Wahanda to enter You in the day’s Sweepstakes draw. Entries must comply with file specifications on the entry page and must be in English.
3. Only one (1) entry per person permitted per day.
4. The Sweepstakes shall begin at 12:01 am EST on December 13, 2010 and will end at 11:59 pm EST on December 24, 2010 (the "Sweepstakes Period"). One (1) Prize will be awarded daily for each sweepstakes. A total of twelve (12) Prizes will be awarded during this twelve (12) day period. The closing time for each day’s sweepstakes is 11:59 pm EST. By submitting Your information, Your name will be automatically entered into a random drawing for the Prize (defined below) from among all eligible entries received. All entries must be submitted at the Web Site, during the period that the Sweepstakes is being offered, according to all applicable directions as listed on the Web Site, or the entry will be void. Winners will be chosen at random after the close of each day’s sweepstakes and will be informed by email of the result. Prizes must be claimed and details confirmed within three (3) days of notification of winning. If a winner cannot be reached after a reasonable effort has been made during three (3) business day’s from Wahanda’s first attempt, Wahanda reserves the right to select a backup winner who will also be chosen at random. If any Prize or Prize notification is returned as undeliverable, the winner may be disqualified and an alternate winner will be selected. Odds of winning will depend on the number of eligible entries received during the Sweepstakes Period.

ELIGIBILITY
6. No purchase necessary and free to enter: To enter the Sweepstakes, You must be a resident of the fifty (50) United States or the District of Columbia (Washington D.C.) over the age of 18 with access to the Internet at all times during the Sweepstakes and subsequent Prize-award period. Employees of the Wahanda and their immediate family members and persons living in their households are not eligible to enter the Sweepstakes or win a Prize. Employees of the Wahanda' respective affiliates, subsidiaries, parents, representatives, and advertising/ promotion/ publicity agencies doing business with the Wahanda are also not eligible to enter the Sweepstakes or win a Prize. This Sweepstakes is void in Puerto Rico and the U.S. Virgin Islands and wherever prohibited or restricted by law, and all federal, state, provincial, and local laws and regulations apply. Void where prohibited or restricted by law. Entry in the Sweepstakes constitutes Your full and unconditional acceptance of these Official Rules.
PRIZES
7. Each day one Entrant will be selected at random to win one (1) Prize. The approximate retail value of the Prize will vary by sweepstakes, but in no event shall such Prize be valued equal to or more than three hundred U.S. Dollars.
8. Wahanda will ship the Prize to the winner directly.
9. The Prizes, and any part thereof, a not transferable or assignable. There shall be no substitution of a Prize for cash or other goods and services, except that the Wahanda reserve the right to provide a substitute Prize or Prizes, of approximately equal or greater value than the original Prize(s), if the advertised Prize(s) becomes unavailable. Only the advertised number of Prize(s) will be awarded. The value of the Prize(s) may be taxable to the Sweepstakes winner/ Prize recipient as income, and it is up to the winners to investigate and report the winnings to the relevant agencies & authorities. All applicable federal, state, local, and other taxes of Prizes are the sole responsibility of the applicable winner.
ENTRY HANDLING
10. Wahanda is not responsible for transmission and/ or computer error. For the avoidance of doubt, acceptance of entries or submissions will not be deemed to waive any provisions of these Official Rules, and the Entrant may subsequently be disqualified. Wahanda is not responsible for lost, late, illegible, incomplete, stolen, or misdirected entries. In the event of a dispute, an entry will be deemed submitted by the authorized account holder of the e-mail address submitted at the time of entry. An "authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet Access Provider, online service provider, or other organization (e.g., business, educational institute) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
11. By submitting an entry, You confirm Your understanding and acceptance of these Official Rules. Also, by submitting an entry, You expressly agree to be bound by the terms and conditions contained in these Official Rules.
12. In addition, by submitting an entry, You expressly grant authority to Wahanda and all of its respective past, present, and future parents, subsidiaries, divisions, affiliates, predecessors, successors, transferees, and assigns, to use Your name, address (city and state only), likeness, and/ or voice in any manner and in any and all media now or hereafter known throughout the world in perpetuity without further approval by, or notification or compensation to, You, unless prohibited by law. Winners also agree to be featured in the Wahanda Blog. Prize winner grants Wahanda the right to use and publish winner's proper name and state of residence online in connection with the Sweepstakes. Acceptance of a Prize constitutes permission for Sponsor and its affiliates to take photographs and/or video of each Prize winner, and use winner's name and likeness solely for advertising and promotional purposes as Sponsor so determines without notice or further compensation, except where prohibited by law
13. By entering the Sweepstakes, entrants agree that each Wahanda and/ or their respective affiliates and subsidiaries may send You promotions and special offers they feel may be of interest to You.
DISQUALIFICATION
14. Wahanda reserves the right to reject any entry for any reason. All decisions of Wahanda regarding the eligibility of an entry are final. Wahanda, in its sole discretion, reserves the right to disqualify any person suspected of tampering with the entry process or the operation of the Sweepstakes website, or otherwise violating the Official Rules. Use of bots or any other type of automated process to enter is prohibited and will result in disqualification. Any attempt by any person to damage any web site or undermine legitimate operation of a Sweepstakes may constitute a violation of criminal and civil laws, and should such an attempt be made, Wahanda reserves the right to seek damages from and/ or to prosecute any such person to the fullest extent permitted by law. Any such tampering also will result in ineligibility to win any Prize in the Sweepstakes.
RIGHT TO CANCEL/TERMINATE/MODIFY
15. Wahanda reserves the right to cancel, terminate, or modify the Sweepstakes if they are not capable of completing the Sweepstakes as planned, whether due to infection by computer virus, computer bugs, tampering, unauthorized intervention, force majeure, or technical failures of any sort
APPLICABLE LAW
16. The Sweepstakes, and all disputes arising between Entrant and Wahanda, shall be governed, construed, and enforced in accordance with the laws of the State of New York, without regard to choice of law provisions. Entrant irrevocably consents to the exclusive jurisdiction of the federal and state courts located in New York County (NY) with respect to any matter relating hereto, and hereby waives the defense of forum non conveniens to any such action.
SEVERABILITY
17. Each of these Official Rules shall be severable, and if any one of them is held invalid or unenforceable for any reason, such rule(s) shall be adjusted to the minimum extent necessary to cure such validity; the remaining rules shall continue in full force and effect to the fullest extent permitted by law. The invalidity or unenforceability of one or more of the rules shall not affect any other rule. Further, the invalidity or unenforceability of any rule hereof in any particular jurisdiction shall not affect the validity or enforceability of such rule in any other jurisdiction.
WAIVER OF LIABILITY
18. ENTRANT AGREES THAT WAHANDA SHALL NOT BE LIABLE FOR ANY AND ALL DAMAGES (AS WELL AS COSTS AND EXPENSES RELATED THERETO, INCLUDING ALL ATTORNEYS' FEES AND COSTS) THAT ENTRANT MIGHT INCUR RELATED OR CONNECTED IN ANY WAY TO THE CONTEST. THIS WAIVER OF LIABILITY IS AN EXPRESS CONDITION FOR THE ENTRANT TO BE ELIGIBLE TO ENTER THE CONTEST. IN NO EVENT SHALL WAHANDA BE LIABLE TO ENTRANT OR TO ANY THIRD-PARTY FOR ANY DIRECT, INDIRECT, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES RELATED IN ANY WAY TO THE CONTEST, WHETHER OR NOT HE/ SHE/ IT WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. RELEASE/ INDEMNIFICATION
19. BY ENTERING THIS SWEEPSTAKES, EACH ENTRANT HEREBY VOLUNTARILY AND IRREVOCABLY RELEASES, AGREES TO INDEMNIFY AND HOLDS HARMLESS AND AGREES NOT TO INSTITUTE ANY CLAIM AGAINST WAHANDA, OR ANY OF THEIR RESPECTIVE AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES AND AGENTS FROM ANY LOSSES, DAMAGES, OR EXPENSES FROM ANY AND ALL INJURIES, LOSSES OR DAMAGES OF ANY KIND ARISING FROM OR IN CONNECTION WITH, EITHER DIRECTLY OR INDIRECTLY, (1) THE AWARDING, ACCEPTANCE, RECEIPT, POSSESSION, USE AND/ OR MISUSE OF THE PRIZE AWARDED HEREIN; AND/ OR (2) PARTICIPATION IN THE CONTEST, ENTRANT'S ENTRY SUBMISSION, OR ANY PRIZE RELATED ACTIVITIES. By accepting the Prize, the Winners agree to release and hold Wahanda and their agents and affiliates harmless from and against any and all losses, damages, rights, claims, actions and liabilities of any kind in connection with the Sweepstakes or receipt or redemption of the Prize. The winner assumes all liability for any injury, death, or damage caused, or allegedly caused, by participating in the Sweepstakes or use or redemption of the Prize.
20. NO WAIVER - Any delay or forbearance by Wahanda in exercising any right under these Official Rules shall not be deemed a waiver of that right.

21. The personal information collected through the Sweepstakes is subject to Wahanda’s Privacy Policy, located at http://us.wahanda.com/info/privacy-policy/ . By entering the Sweepstakes, You agree to the use of Your personal information as described in the above Privacy Policy.
22. WINNERS LIST - A request to receive a list of the Prize winner must be made in a writing addressed to Wahanda, 1 Union Square West, Suite 208, New York, New York, 10003. All requests must include a self-addressed, stamped return envelope. Requests must be received by January 1, 2011.
